This is the hot debate in the public domain that why Aryan Khan, son of Gauri Khan and Shah Rukh Khan is still in jail?
One simple legal fact is that he is in jail because he is accused of consuming and trade of narcotics subsistence.
By law, one can not assume that a person is innocent just because that the offensive items or articles did not found under the position of the suspected person.
However, additional evidence is needed in this situation, else the said person can be subject to the benefit of the doubt.
Why Aryan Khan is still in jail, after their initial arrest as an accused?
The conception from the common person to the legendary lawyer such as Prashant Bhushan is that Aryan Khan is in jail because of NCB zonal director Sameer Wankhade.
But this is not the correct answer.
He is in jail because of the decision of the Bombay High Court.
Both Aryan Khan and NCB gave their evidence, argument, and explanation before the Bombay High Court.
And it is the Bombay High Court that has decided to put Aryan Khan remain in jail as under judicial custody of NCB. Even by law, the NCB have no judicial or legal power to take and keep any person in their custody without judicial due process and approval.
Therefore the public perception including the opinion of the lawyer is absolutely wrong and bias to accuse the NCB director Sameer Wankhade that Aryan Khan is still in jail because of him. He is still in jail as judicial custody because of the Bombay High Court Judgement.
